Notice of Public Hearing:  Proposed General Permit Regulation relating to Living Shoreline, July 2015

The Virginia Marine Resources Commission (VMRC) invites public comment on a proposed general permit regulation 4VAC 20-1300-10 ET SEQ entitled: “Living Shoreline Group 1 General Permit for Certain Living Shoreline Treatments Involving Tidal Wetlands.” Pursuant to § 28.2-104.1 of the Code of Virginia, the regulation describes the qualifications, procedures and manner of registration to qualify for a general permit for certain activities in tidal wetlands requiring authorization from VMRC or a local wetlands board.

The purpose of the general permit regulation is to provide a streamlined permitting process as an incentive to encourage property owners to utilize a living shoreline approach as appropriate, to manage shoreline erosion, and promote the planting and growth of tidal wetlands vegetation to restore or enhance ecosystem services.

In accordance with §§ 28.2-103 and 28.2-209 of the Code of Virginia, a public hearing on the proposed general permit regulation will be held during the Commission’s monthly meeting that begins at 9:30 a.m. on Tuesday, July 28, 2015, at the Marine Resources Commission, 4th Floor meeting room, 2600 Washington Avenue, Newport News, Virginia. Written comments on the proposed general permit regulation should be mailed to Chip Neikirk, VMRC Habitat Management Division, 2600 Washington Avenue, 3rd Floor, Newport News, Virginia 23607, by 5:00 p.m. Friday, July 24, 2015. A copy of the proposed general permit regulation may be reviewed at the Commission offices Monday through Thursday, 8:00 a.m. to 5:00 p.m. and Friday 8:00 a.m. to 2:30 p.m. The proposed general permit regulation is also available on the VMRC website www.mrc.virginia.gov (click here for regulation draft) and copies may also be obtained by calling our office at (757) 247-2254.
