Public Notice:  Proposed Regulations, July 2015

The Virginia Marine Resources Commission invites public comment on the establishment of amendments to regulations, as proposed below. By July 13, 2015, the proposed draft regulations may be viewed at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia. 

In accordance with Section 28.2-209 of the Code of Virginia, a public hearing on the proposed regulations will be held no earlier than 12:00 noon, on Tuesday, July 28, 2015, at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia. Public comments on the proposals should be provided to Robert L. O’Reilly, VMRC Fisheries Management Division, 2600 Washington Avenue, 3rd Floor, Newport News, Virginia 23607, by 12:00 p.m., Monday, July 27, 2015.

I. Chapter 4 VAC 20-610-10 et seq., “Pertaining to Commercial Fishing and Mandatory Harvest Reporting”

The Commission proposes to amend Chapter 4 VAC 20-610-10 et seq., to modify criteria for an exception to the two-year delay process for a Commercial Fisherman Registration License as provided by Section 28.2-241 of the Code of Virginia.

The purpose of these amendments is to allow fair and equitable entry into the fisheries.

II. Chapter 4 VAC 20-560-10 et seq., “Pertaining to Shellfish Management Areas”

The Commission proposes to amend Chapter 4 VAC 20-560-10 et seq., to modify the lawful season and area for harvest of clams by patent tong from the Newport News Shellfish Management Area and prohibit additional lease applications within the Newport News Shellfish Management Area. The proposed amendment would establish May 1 through September 30 as the lawful season for the harvest of clams by patent tong from the Newport News Shellfish Management Area. The current lawful season is December 1 through April 30.
