Pertaining to Dredging in Submerged Aquatic Vegetation January 1998

NOTICE

The Virginia Marine Resources Commission invites public comment on a proposed regulation to replace Emergency Regulation 4 VAC 20-1000-10 et seq., "Pertaining to Dredging in Submerged Aquatic Vegetation." A summary of the proposed regulation is presented below.

In accordance with §28.2-209 of the Code of Virginia, a public hearing on the adoption of the proposed regulation will be held at 12:00 noon on Tuesday, January 27, 1998 at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia. Written comments on the proposed regulation should be mailed to Jack Travelstead, VMRC Fisheries Management Division, P. O. Box 756, Newport News, VA 23607. A copy of the proposed regulation may be reviewed at the Commission during Monday through Friday, 8:15 a.m. to 5:00 p.m. Persons interested in obtaining a copy of the proposed regulation may call the Commission at (757) 247-2248.

Purpose and Summary of Proposed Regulation:

Purpose: The purpose of the proposed regulation is to provide for the short-term and long-term conservation of submerged aquatic vegetation in Chincoteague Bay and adjacent waters.

Proposed Regulation:

A. It shall be unlawful for any person to use or have overboard any dredge within those waters of Chincoteague Bay and Assateague Channel and Bay which are bounded on the south by the State Route 175 Chincoteague Causeway and the Assateague Island bridge and on the north by the Virginia-Maryland state line, except as provided in "B" below.

B. It shall be lawful to use a dredge within that area of Chincoteague Bay which is bounded by a line beginning at a point on the Virginia-Maryland State Line, located at NAD 83 Lat 38-00-55.96433 N / Lon 75-22-23.95288 W being Va South NAD 27 coordinates N 627,356.85 / E 2,900,569.52 , said point being Corner 7; thence grid azimuth 81-29-46 a distance of 12,519.98 feet along the Virginia-Maryland State Line to Corner 6, N 629,208.26 / E 2,912,951.85 ; thence grid azimuth 226-52-56 a distance of 20,741.23 feet to Corner 5, N 615,031.6 / E 2,897,811.8 ; thence grid azimuth 161-48-07 a distance of 3,410.48 feet to Corner 4 , N 611,791.7 / E 2,898,876.9 ; thence grid azimuth 135-53-32 a distance of 4,936.13 feet to Corner 3, N 608,247.4 / E 2,902,312.5 ; thence grid azimuth 213-53-14 a distance of 3,700.59 feet to Corner 2, N 605,175.4 / E 2,900,249.2 ; thence grid azimuth 268-13-59 a distance of 10,956.11 feet to Corner 1, N 604,837.6 / E 2,889,298.3 ; thence grid azimuth 13-13-41 a distance of 12,307.46 feet to Corner 9, N 616,818.5 / E 2,892,114.6 ; thence grid azimuth 48-26-21 a distance of 11,380.80 feet to Corner 8, N 624,368.7 / E 2,900,630.3 ; thence grid azimuth 358-50-05 a distance of 2,988.77 feet to Corner 7, the point of beginning on the Virginia-Maryland State Line.

C. As set forth in §28.2-903 of the Code of Virginia, any person violating any provision of this chapter shall be guilty of a Class 3 misdemeanor, and a second or subsequent violation of any provision of this chapter committed by the same person within 12 months of a prior violation is a Class I misdemeanor.
