Public Notice: Proposed Regulations, June 2010

The Virginia Marine Resources Commission invites public comment on the proposed amendments to regulations listed below. 

In accordance with Section 28.2-209 of the Code of Virginia, a public hearing on the proposed regulations will be held at 12:00 Noon, on Tuesday, June 22, 2010, at the Virginia Marine Resources Commission, 2600 Washington Avenue, Newport News, Virginia.  Written comments on the proposals should be mailed to Jack Travelstead, VMRC Fisheries Management Division, 2600 Washington Avenue, 3rd Floor, Newport News, Virginia 23607, by 5:00 p.m., Monday, June 21, 2010.  Copies of the proposed regulations may be reviewed, at the Commission, Monday through Thursday, 8:15 a.m. to 5:00 p.m. and Friday, 8:00 a.m. to 2:30 p.m. and may be obtained by calling the Commission at (757) 247-2248.

1)  Chapter 4VAC20-450-et seq. "Pertaining to the Taking of Bluefish".   

The Commission proposes to amend Regulation 4VAC20-450-10 Et Seq., "Pertaining to the Taking of Bluefish" to establish the 2010 commercial bluefish quota, as 1,213,280 pounds.  The purpose for this amendment is to comply with the federal and interstate plans for this species. 

2)  Chapter 4VAC20-950-10 et seq. "Pertaining to Black Sea Bass"

The Commission invites public comment on a proposed amendment that would establish the 2010 open recreational black sea bass fishing season from May 22 through October 11 and November 1 through December 31.  The current open recreational season dates are May 22 through August 8 and September 4 through October 4.  The purpose for this amendment is to comply with the interstate fishery management plan for this species.

3)  Emergency Chapter 4VAC20-752-10 et seq. "Pertaining to Blue Crab Sanctuaries"

On May 25, 2010, the Commission adopted, under its emergency regulatory authority (Section 28.2-210 of the Code of Virginia), emergency amendments to Chapter 4VAC20-752-10 et seq.  The amendments remove latitude-longitude coordinates associated with physical markers, such as lights and buoys, that already define the blue crab sanctuaries.  The effective date of the emergency amendment is May 25, 2010.  The Commission proposes to make this emergency amendment, described above, a permanent part of this chapter.
