VIRGINIA MARINE RESOURCES COMMISSION
"ESTABLISHES AREA CLOSED TO GILL NETS"
REGULATION 4 VAC 20-680-10 ET SEQ.
This regulation establishes an area along the southern shore of the Chesapeake Bay and Atlantic Ocean between the Hampton Roads Bridge-Tunnel and Dam Neck which is closed to gill nets.
This regulation is promulgated pursuant to authority contained in §28.2-201 of the Code of Virginia.
This regulation amends previous Regulation 450-01-0091, which was adopted May 25, 1993 and effective June 1, 1993, and rescinds previous Regulation 450-01-0092, which was adopted June 22, 1993, and effective July 1, 1993, and reenacts its provisions in this regulation. The effective date of this regulation is April 14, 1995.
4 VAC 20-680-10. Purpose.
The purpose of this chapter is to preserve public safety and reduce conflicts between gill net fishermen and others in this area.
4 VAC 20-680-20. Rescission.
VR 450-01-0092 is rescinded, and its provisions are reenacted in 4 VAC 20-680-30 of this chapter.
4 VAC 20-680-30. Gill net closed season and area.
From May 15 through September 15 of each year, it shall be unlawful for any person to place, set, or fish any gill net within 400 feet of the shoreline in the area bounded by the Hampton Roads Bridge-Tunnel eastward to Cape Henry and south to the southern ocean front boundary of the United States Dam Neck Military Base.
4 VAC 20-680-40. Penalty.
As set forth in § 28.2-903 of the Code of Virginia, any person violating the provisions of this chapter shall be guilty of a Class 3 misdemeanor and a second or subsequent violation of any provision of this chapter committed by the same person within 12 months of a prior violation is a Class 1 misdemeanor.
